Una incapacidad es aquel dictamen emitido por un médico donde se certifica que una persona no puede seguir ejerciendo determinada actividad. Por lo tanto se ejecuta una acción de incapacidad donde no puede seguir prestando servicios a la empresa y el estado debe compensar al trabajador.

Todo esto en cumplimiento de la ley que estipula que ante eventualidades de esta índole, el estado debe brindarle su seguridad social a que tiene derecho.

Es importante resaltar que la incapacidad debe ser certificada por un médico del IMSS como institución del estado y puede ser incapacidad temporal o permanente. Lo que estipula un rango de pago en base al tipo de incapacidad y por consiguiente esto genera un pago específico o predeterminado.

Tipos de incapacidadincapacidad

La incapacidad según lo dictaminado por un doctor, puede clasificarse de la siguiente manera:

  • La Incapacidad Temporal.
  • Incapacidad Permanente.

Ambos con un grado de dificultad que debe ser evaluado por un médico tratante y que en cierta forma rendirá el informe al IMSS. Esto para que sea la institución quien fije el monto que le será concedido por concepto de pensión por incapacidad.

A continuación te detallaremos cada una de ellas para una mejor compresión sobre el tema que sigue siendo interesante.

Incapacidad Temporal

Aquí se presenta una incapacidad para trabajar por un tiempo determinado y en el que no se estipula la causa especifica del mismo. Ya que la causa puede provenir de cualquier factor y su imputación es de carácter aceptable aunque esta no esté relacionada con el trabajo.

La duración de una incapacidad temporal está en el rango de los 15 días hasta 18 meses como tiempo máximo de la misma. Pero para el goce del beneficio para una incapacidad temporal, el trabajador debe haber cotizado un mínimo de cuatro semanas ante el IMSS.

Sin embargo existe otra normativa para trabajadores eventuales que estipula el goce del beneficio si el mismo ha cotizado un mínimo de 6 semanas. Esto siempre y cuando la eventualidad se ha presentado en los cuatro meses siguientes de la afiliación y por consiguientes a la solicitud del beneficio.

Lo que se constituye en una alternativa económica que como su nombre lo indica, temporal, pero que siempre hay que prever según los lineamientos exigidos.

Incapacidad permanente

Una característica similar entre la incapacidad temporal y la permanente, es que la causa no es evaluada en cierta medida para poder otorgar el beneficio. Esto debido a que la prioridad es la integridad que se le otorgue al trabajador y por el hecho de presentar determinada incapacidad.

Por lo que se procede a evaluar otros factores como la posibilidad de realizar determinada actividad ya sea física o mental en el trabajo.  Por lo que debe evaluarse si se encuentra apto para desempeñarla a corto, mediano o largo plazo.

De no existir ninguno de los plazos anteriormente descritos para reincorporarse a sus labores habituales en el trabajo, este es considerado una incapacidad permanente. Esto aunque para otros trabajos sea calificado como apto para desempeñar sus labores cotidianas pero que en esencia sea previamente evaluado.

Es importante mencionarte que el beneficio de la pensión por incapacidad es dictaminado por el IMSS en base al informe suministrado por un médico laboral. Por lo tanto es quien deberá evaluar todos los aspectos en el que se desenvuelve el trabajador y sus condiciones físicas y mentales.

Solicitar el pago de incapacidad ante el IMSS puede ser realizado de dos formas:

  • Presencial ante cualquier oficina del IMSS.
  • Vía internet a través del portal web oficial del IMSS.

Cada una de ellas con un procedimiento especifico que te mencionaremos a continuación y que te recomendamos seguir al pie de la letra.

Solicitud presencial

Este es un proceso básico en el que tú como solicitante debes acudir personalmente a la sede del Instituto Mexicano del Seguro Social IMSS. Para ser más específico, acudir a la Unidad de Medicina Familiar o también conocida como Sub-delegación del IMSS para gestionar solicitudes.

Allí será atendido en el horario de 8:00 AM a 3:00 PM de lunes a viernes.

Solicitud vía Online

En esta opción se presenta la alternativa de realizar la solicitud vía online pero con el cumplimiento de los requisitos exigidos para ello. Estos deben estar en formato digital, ya sea en PDF o JPG nítido y de mediana resolución para poder ser adjuntado a la solicitud.

Como solicitante debes tener en cuenta que de requerirse una futura evaluación médica, debes acudir al médico laboral del IMSS asignado a la brevedad posible.

Requisitosimss

  • Mostrar el original y consignar una copia del CURP.

  • De igual forma se debe mostrar y consignar una copia de algún documento que posea la clave bancaria Estandarizada conocida como e.firma o en su efecto el número de cuenta.

Con estos requisitos y la aprobación del beneficio de incapacidad por parte del IMSS, se procederá al pago en cualquiera de las entidades bancarias autorizadas.

¿Dónde cobrar el pago de la incapacidad?banamex

El gobierno de México dispone de tres entidades bancarias las cuales están autorizadas para gestionar el pago por incapacidad a quienes lo hayan solicitado. Por lo que a continuación te las mencionaremos para que selecciones a cual acudir y concretar el cobro de dicho beneficio proveniente de determinada incapacidad:

  • BANCOMER.
  • BANAMEX.
  • HSBC.

En cualquiera de ellas con tan solo presentar tu documento de identidad, el cajero procesará tu solicitud y procederá al pago correspondiente según lo asignado por el IMSS.

También puedes canalizar el pago mediante una transferencia directa desde el Instituto Mexicano del Seguro Social. Pero este método de pago debe ser canalizado previamente por el portal web del IMSS y consignando ciertos documentos bancarios donde se gestionara el pago.
