Hoy queremos darte a conocer los Requisitos para ser Ejidatario, un tema de mucha importancia en el país.

La posesión es uno de los temas de larga data, porque su explotación fue una de las primeras formas de subsistencia humana, se dice incluso que la mujer fue la primera persona que cultivó la tierra, y por eso se le representa con una manzana en la mano.

La tierra es el futuro, es la antesala de la revolución verde, en México, millones de personas viven de los ejidos, y de allí radica parte de su importancia, veamos todo lo relacionado a este tema.

Requisitos para ser Ejidatario

La adquisición de ejidatario en México amerita un conjunto de requisitos que son los siguientes:

REQUISITOS PARA SER EJIDATARIO

  • Constituir o formar el ejido con 20 o más individuos naturales, mayores de edad o de cualquiera otra (si tiene familiar a su cargo), u otro detalle que contenga el reglamento interno y no colide con la normativa legal.
  • Determinar cuál el aporte de terreno propio que hace cada miembro de la asociación (propiedad agrícola, de temporal, de riego, de humedad), pero siempre no más del 5% del total.

Además, deben estar acreditadas por el Registro Público de Propiedad correspondiente RPP y estar libres de gravámenes (hipotecas, impuestos, u otros) pues de lo contrario se considerará nula su aportación.

  • Elaborar un reglamento interno acoplado con las disposiciones de la Ley Agraria.
  • Contar con un plano general que identifique las poligonales topográficas de las tierras cedidas y que está acorde con las normas técnicas del RAN.
  • Elaborar la escritura pública, que debe tener los siguientes elementos: certificación de la aportación de tierras, identificación de los individuos participantes, los derechos de cada uno, el reglamento interno, los integrantes de la comisariado ejidal, y el Consejo de Vigilancia; entre otros.
  • Finalmente, proceder a la inscripción en el Registro Agrario Nacional del documento por el cual se constituye la asociación de Ejidos.

¿Qué es un Ejidatario?

Un Ejidatario es un miembro de un grupo agrario en el que participan varios dueños de terrenos destinados a labores agrícolas u otros similares para beneficio familiar o social.

EJIDATARIO

Históricamente esta figura estuvo ligada a los proyectos de Reforma Agraria de México que proponían la formación de núcleos de ejidos cual si fueran bienes colectivos, indivisibles y sin potestad de ser vendidos o heredados.

Durante el siglo XX su normativa cambió sucesivamente según los planes socioeconómicos y políticos de las gestiones gubernamentales que se hallaban en el poder, hasta que llegó a lo que es ahora: un proceso legalmente constituido en el que participan gran cantidad de mexicanos que viven de la tierra.

Anteriormente, el Ejido era una especie de solar o campo de labor agrícola  de propiedad comunal en el cual se criaba ganado o sembraba la tierra para aprovisionar al pueblo, de modo que era un sitio para la trilla y guardado momentáneo de los granos o productos obtenidos en el usufructo del terreno, por lo común ubicado en las afueras de los caseríos, sean pastizales, bosques, u otros.

Además, tenían la propiedad de poder expandirse; a tal punto, que algunos terratenientes posteriores llegaron a ser “dueños” de todo un pueblo, incluyendo ríos, quebradas, y demás.

Importancia del Ejidatario

El Ejidatario, una vez que adquiere la acreditación para ser miembro del grupo, tiene el derecho de utilizar, explotar, sembrar, criar ganado, o realizar las actividades agrícolas o productivas necesarias para la subsistencia, comercio interno o externo, u otras que se hayan acordado en el Reglamento Interno de los propietarios asociados.

Así que no sólo disfruta de los beneficios de sus parcelas, o de la corresponsabilidad que haya adquirido, sino que también ello se extiende a los pueblos circunvecinos, mediante la formación de otras asociaciones conexas como cooperativas de consumo, depósitos de almacenaje de productos, grupos de productores de café, maíz, entre otros.

Entonces, puede verse la importancia que tienen las formaciones de grupos destinados a la productividad, el desarrollo económico regional y nacional, y por tanto,  al bienestar de todos los ciudadanos del país.

¿Cómo se acredita el Ejidatario?

En general, la condición de ejidatario se acredita de tres formas:

  • Adquiriendo el Certificado de derechos agrarios emanado de la autoridad competente.
  • Mediante el Certificado parcelario o de derechos comunes.
  • A través de la sentencia o resolución expedida por tribunal agrario.

Es importante recordar que el adjudicatario tendrá la potestad de nombrar a quien deba heredar sus derechos sobre la zona o espacio de su propiedad y otros inherentes a su condición de ejidatario, para lo cual tiene que dejar una especie de documento o testamento que clarifique esos aspectos.

¿Cómo funciona el Ejidatario?

El Ejido es propiamente una institución social que funciona en un lugar geográfico, a través de un grupo de vecinos de un poblado o varios, cuya propiedad de la tierra es inalienable, no puede ser transferible (aunque sí es heredable) ni expropiable, aparte de que se destina para la explotación o producción de bienes de consumo. ​

Entonces, los ejidos abarcan la tierra comunal, los tipos de parcelas individuales y un espacio urbano; los titulares de derechos pueden llegar a ser ejidatarios, posesionarios y avecindados.

De acuerdo con la Ley Agraria los primeros son los propietarios legales de la parcela; los segundos son los que tiene parcela hasta tanto se apruebe su petición de los derechos del lugar; los últimos o avecindados son aquellos a quienes se les permite vivir en el terreno, aunque sin derecho sobre la tierra.

En México, gran parte de su territorio está en posesión de unos 15 millones de ciudadanos que dependen de los terrenos como medio de subsistencia.​

En relación con este tema de la posesión de la tierra se planten por lo común dos puntos de vista: una que está de acuerdo con la promoción o creación de los ejidos y otra que los considera un error de política social.​

El primer enfoque considera que es una forma de organización que contribuye al desarrollo de los pueblos y comunidades; mientras que el segundo enfoque apunta que la explotación de la tierra no ha dado los frutos que se esperaban y citan ejemplos que apoyan sus observaciones.

¿Cómo se pierde la calidad del Ejidatario?

La condición de ejidatario se puede perder por varias causas que vamos a nombrar, sin tener que mencionar artículos, parágrafos, o acápites de la Ley, que puede ser consultada por otro lado.

  • Por la renuncia o cesión legal de los derechos parcelarios y comunes, en cuyo caso se entenderán cedidos a favor del núcleo de población.

Ello debe hacerse por escrito y certificación ante el Notario Público o a través de Jurisdicción Voluntaria, exponiendo la renuncia a favor de la asociación o núcleo agrario. Por lo demás, la sentencia judicial deberá inscribirse en el órgano registral.

  • Mediante una resolución judicial dictaminada por un tribunal agrario, debido a alguna causal que lo amerite.
  • Debido a la prescripción conforme al artículo 48 de la Ley Agraria, en cuyo caso la sentencia de prescripción dictamina la pérdida de la condición de ejidatario del sujeto, y tiene que estar inscrita ante el órgano de registro legal.

¿Qué es el Registro Agrario Nacional?

El RAN es el Registro Agrario Nacional, o institución del estado de México perteneciente a la  Secretaría de Desarrollo Agrario, Territorial y Urbano, designado para coordinar y controlar el tema de la tenencia de la tierra ejidal y comunal, así como facilitar la seguridad jurídica documental  que se desprende de la observancia de la Ley Agraria.

Asimismo, le compete ejercer diferentes funciones, tales como:

RAN

  • Inscribir y asesorar a los propietarios de terrenos para la obtención de los papeles o requisitos para constituir una asociación ejidal, con sus estatutos, identidad y número de miembros, planos topográficos u otros.
  • Atender al registro de dicha asociación, examinar las modificaciones que se hagan a la propiedad de las tierras, y efectuar las recomendaciones pertinentes.
  • Velar por la garantía de los deberes y derechos legalmente constituidos sobre la propiedad ejidal y comunal, así como de las personas que constituyen el lote de ejidos, de acuerdo con lo previsto en la ley.
  • Participar en el ordenamiento y regularización de la propiedad en las zonas rurales, sociales  o privadas, a través del registro, publicación, archivo, documentación y expedición de los certificados de constitución de ejidos.
  • Brindar asistencia técnica y catastral a los asociados a fin de que puedan gestionar la concreción de datos de los terrenos, medidas topográficas y planos de la superficie, entre otros.
  • Otras funciones que estipule la Ley Agraria o basadas en la cooperación mutua.

No podríamos terminar sin añadir que, el futuro de la Humanidad no está sino en la actividad agrícola, en el retorno al campo, puesto que, los minerales, el carbón, el petróleo se agotan, pero en cambio tenemos terreno todavía cultivable en el mundo.

Los expertos proponen una especie de “revolución verde” como la aplicada hace cierto tiempo en África, ello sin abandonar la ciencia y la tecnología, claro está.
